Prevention of Food Adulteration Act : Rules

NOTIFICATION
New Delhi, the 20th December, 2001

 

G.S.R. 908(E). - Whereas the draft of certain rules further to amend the Prevention of Food Adulteration Rules, 1955 were published as required by-section (1) of Section 23 of Prevention of food Adulteration Act, 1954 (37 of 1954), in the notification of Government of India, in the Ministry of Health and Family Welfare (Department of Health) number G.S.R. 358 (E), dates the 16th May, 2001 in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i), dated the 16th May, 2001 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of thirty days from the date on which copies of the Official Gazette containing the said draft rules was published were made available to the public;

 

And whereas, the copies of the said Official Gazette were made available to the Public on the 17th May 2001;

 

And whereas the objections and suggestions received from the public on the said draft rules have been considered by the Central Government;

 

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 23 of the said Act, the Central Government, after consultation with the Central Committee for Food Standards, hereby makes the following rules further to amend the Prevention of Food Adulteration Rules, 1955, namely;

 

RULES

(1) These rules may be called the Prevention of Food Adulteration (9th Amendment) Rules, 2001.

(2) They shall come into force after six months from the date of its publication in the Official Gazette.

In the Prevention of Food Adulteration Rules, 1955, - (I) in rule 32, -

 

(A)

in clause (b), after the fifth proviso, the following proviso shall be inserted, namely :-

"Provided also that for all Vegetarian Food. -

 

 
(a) a declaration to this effect shall be made by a symbol and colour code so stipulated for this purpose to indicate that the product is Vegetarian Food. The Symbol shall consist of a green colour filled circle, having a diameter not less than the minimum size specified in the Table given below, inside the square with green outline having side double the diameter of the circle, as indicated in clause (17) of sub-rule (ZZZ) of rule 42;

(b)

the symbol shall be prominently displayed.-

 

 

(i) on the package having contrast background on principal panel, (ii) just close in proximity to the name or brand name of the product, and (iii) on the labels, containers, pamphlets, leaflets, advertisements in any media:

Provided further that the provisions of these rules shall not apply in respect of any Vegetarian food which is manufactured and packed without the symbol before the commencement of the Prevention of Food Adulteration (9th Amendment) Rules, 2001:

Provided also that the provisions of these rules shall not apply in respect of mineral water of packaged drinking water or carbonated water or liquid and powdered milk.

 

(b)

after Explanation - IX, the following Explanation shall be inserted, namely :-

'Explanation X- "Vegetarian Food" means any article of food other Non-Vegetarian Food as defined in Explanation IX of this rule';

(II) in rule 42, in sub-rule (ZZZ), after clause (16), the following clause shall be inserted, namely:-

"(17) Every package of Vegetarian Food shall bear the following symbol in green colour on the principal display panel just close in proximity to name or brand name of the Food, namely: -

Note: - The Prevention of Food Adulteration Rules, 1955 were published in Part II, Section 3 of Gazette of India vide S.R.O. 2105 dated 12-9-1955 and were last amended vide G.S.R. No. 895 (E) dated 11-12-2001.
